Commission owed when leaving a role?

Brand new member here.


How have you guys/gals handled conversations around commissions owed when transitioning out of one company for your next opportunity?


I'm a CA based sales person.

I’ve had colleagues that had to put up a bit of a fight about it and, luckily, her sales director advocated for her and she got paid but they were 100% going to try to fuck her over. 

To play devil’s advocate, this stipulation was included in our contracts but its still such a bad practice. Essentially, giving your notice disqualifies you from receiving any owed commish.

It’s so misguided because at what cost are you pocketing that commission as an employer? You want to incentivize zero notice and sandbagging from outgoing employees? So ridiculous...

That's crazy....commission isn't free money...its money that was earned and therefore owed to the person who earned it.

I know in CA it's owed on work already performed and mandated to be paid out. Not sure in other states.

I never had an issue with it, but I know a friend who did.
She reminded them that it’s a standard practice to pay for any deals closed and invoiced during her tenure.
She then asked them to confirm the outstanding commission and pay date via email, and only once she had that info did she return her laptop and screen and other stuff.
It’s really not worth it for the company to try and fuck you over for a few thousand dollars
