Commission Payout After Resigning

Howdy,


I hope everyone is starting their holiday break a little early with some eggnog.


Our company is closing down for the holiday break tomorrow and I will giving my two weeks the day we get back from break, but I am still owed commission.


Do you think that they will pay me out on the commission they owe or am I screwed?


Appreciate any thoughts and ways to negotiate better.

What paddy said, but also check your plan. If they don't specifically address it, then you're likely screwed if you leave.

Even if the plan says he should get it they might not pay. Then good luck getting anything without dropping $$$ for legal expenses.

Had it happen to me. Fortunately I had moved on to bigger and better things and it solidified my decision to leave.

If both parties signed the plan with a clause stating you will get paid despite leaving and they hold out, that's an easy win in court. In California the losing party has to cover all legal fees as well. I'd take that challenge any day. They're counting on you to be afraid to challenge them.

What is in your compensation plan? The language should be clear and unwavering. You either have to be employed on the date of payment, or it will state otherwise.

It should very clearly state what the resignation payout process for earned commission is in your comp plan. Some companies pay some might not, when in doubt just make sure your last day is after pay day.

Check your plan because legally the company has to pay you what’s owed but they could be dicks. My advice would be not to leave until you get paid if you can do that.

Consult your comp plan / sales letter for information on this.

I was surprised to learn the company I currently work for continues to pay out commission due after you leave. They pay 60 days in arrears, so you could conceivably have some big dough coming in while you're already landed in a new role.

All previous companies I've worked for had a clause in the comp plan that stated you must be employed to receive incentive compensation, effectively forcing you to leave any commission due on the table when you leave.

Seems like the latter situation is far more common than the former.

I have also heard of companies paying signing bonuses based on commission due from a previous role, although uncommon. If you're going to have to forfeit your commission when you leave, it might be worth a conversation with your future employer (assuming you already have something lined up).
