Sorry... On a serious note.

I used to begin my calls asking if they had a few minutes. But now I don't and I've found a lot more success. 

Asking if they have a few minutes to chat or if they aren't busy immediately gives the prospect an easy out.

Now I just roll right into the what we do, and immediately ask a question about what they are using. This then allows me to ask a question that let's me understand any pains they may be having and then opens the conversation on how we can solve those pains.

I know I know "tHiS gIvEs ThEm An OuT" they can always hang up no matter what magic words you think you use. 

Personally I love never split the difference and after implementing this years ago I've always seen success. with it

I know you are saying that it doesn't matter asking this question because they can hang up on you whenever they would like to. But I'd argue that by asking this it increases the likelihood that you won't get further into the conversation because once they tell you it is a bad time they have told you they don't want to talk.

By not asking this question though you can roll into it and you make them tell you it's a bad time.
