Non compete

about to sign a contract and there's a non compete.

it's a one year cooling off period.

anyone have experience with these? a big reason its a good job is because it opens doors later on.

non being able to be hired for a year would impede growth.

without poring to much, anyone experience what it's like to have a non compete, and also have it enforced?

In most states in the US a NC is unenforceable.

My last company made everyone sign one and when I quit to a competitor they waived it around telling me I couldn't go work for that company. I laughed at them and said "go for it" when they threatened to enforce it. They never did.

NDA's though - that's a different story.

this, companies do it as a boilerplate thing but it looks really bad to enforce a non compete its rare theyll do it

Unless you're shaping the product itself and have proprietary knowledge of its architecture or C-level strategic information, you'll be fine.

you'd have to check your local labor laws, in certain states, they are not enforceable even if you end up signing it.

Obviously, your best bet is to consult a lawyer, but in general they are unenforceable. In the very rare circumstances that they are enforceable, you usually have to be given some kind of consideration, like a signing bonus, or a contract where if they fire you, they still have to pay you. That kind of thing. Which in the US is rare.

I think, the lawyers fees would be more to actually enforce it.

The company will do a cost benefit analysis.

But anyways, be cautious. See if someone in your org has actually done it? No?
