Demand Letter for variable comp?

Does anyone here have experience sending a demand letter for variable comp?


Backstory:


Joined a startup, they committed in writing a team based comp goal with a variable target. We met the goal, but they only paid 15% of the comp vs achieving 85% of the goal. It's a 5 figure difference in the comp and Im burned so leaving but want that $$.


Has anyone done anything like this before and had success?

If they have in writing stated they would pay X upon achievement of a certain % attainment, and now they are trying to pay a different amount less than stated, lawyer up. If they are shorting a whole group that becomes a class suit most lawyers will take. They will settle out of court and you all get paid. I was in a class suit recently against at a former employer for a very similar situation and won.ย

How did they justify not paying full amount?

They said they hired too many people in the second half of the year, so they needed to spread around the $$. Each of us however have our own salary/OTE numbers and they shorted everyone, leaning on the fact that they grew the team.ย

Like others have said, saying "I'll be honest with you, I don't feel that we're the right partner for you as I don't think we'll be able to meet your expectations" or whatever verbiage makes sense.
