so this is pretty complex. my ex-employer terminated me for "performance" on Jan 19, 2024 whilst still owing me ~$70,000 in commission. my personal belief, the CEO terminated the role because he saw the potential earnings of the sales team and just did away with it altogether. neither me nor the one other salesperson work there anymore.
so I calculated my commissions through the calculator they created and Q3 is about $45k and Q4 is about $15k. they also owe me for my PTO and severance of 3 weeks that my CEO signed off on. they also terminated my insurance without sending me the COBRA info. I'm in Texas- cobra info needs to be sent within 15 days and payout for items other than commission is within 6 days of termination. commission is "within reasonable time".
also, regardless of what I calculate, they're going to say that service hours I sold as part of a deal actually ate up any gross margin that I would have been paid out on. For Q3 they first came back with $3,000 of commission... it was at that point I started looking elsewhere.
I'm fed up. I've spoken with lawyers about this but I'm just about to report them to Texas workforce commission and the Department of Labor to fine them like crazy.
