Ex-employer saga

so this is pretty complex. my ex-employer terminated me for "performance" on Jan 19, 2024 whilst still owing me ~$70,000 in commission. my personal belief, the CEO terminated the role because he saw the potential earnings of the sales team and just did away with it altogether. neither me nor the one other salesperson work there anymore.

so I calculated my commissions through the calculator they created and Q3 is about $45k and Q4 is about $15k. they also owe me for my PTO and severance of 3 weeks that my CEO signed off on. they also terminated my insurance without sending me the COBRA info. I'm in Texas- cobra info needs to be sent within 15 days and payout for items other than commission is within 6 days of termination. commission is "within reasonable time".

also, regardless of what I calculate, they're going to say that service hours I sold as part of a deal actually ate up any gross margin that I would have been paid out on. For Q3 they first came back with $3,000 of commission... it was at that point I started looking elsewhere.

I'm fed up. I've spoken with lawyers about this but I'm just about to report them to Texas workforce commission and the Department of Labor to fine them like crazy.

Solid, I imagine he charges based on what he can bring in or something? If you know.

He has 2 pricing models. I'm exploring those. Going to wait to get my funds up with my new job then initiate the lawsuit, possibly with Dan. Working for the big red again 🙏🏻🙏🏻

But the thing is, they're not a law firm. I definitely believe my old company will force us to go to court.

Sounds like you’re doing the right thing by meeting with a lawyer and reporting them to the right government entities. That would be my suggestion and recommendation. Especially going to a lawyer and getting their advice and threatening to file a lawsuit. A lawsuit will cost that company a lot more money than what they owe you, assuming you are correct.

Reading your other posts, this place sounds shady as hell. Lawyer is absolutely the way to go here. Sounds like being such a small company, execs are looking at that 70k as a huge hit, so they're going to take the easiest and greasiest way out.
If you can name drop, I'm sure lots of Texas folks would be grateful knowing to avoid working there.
Also, make sure to leave a thorough glassdoor review.

You better lawyer up asshole, because I'm not coming back for 30%, I'm coming back for EVERYTHING.

Employers play on the strategy that employees are too desperate/too stupid to actually get a lawyer and fight for what they deserve. Prove em wrong and nail their ass!!
