Commission Issue...be kind!

I was laid off and took a new job without seeing a firm comp plan for variable commission but had it described to me, etc.


Good news: I've closed $700K in a few short months.

Bad news: 4.5+ months in and still no variable comp plan with a recently fired Head of Sales.


I have a paper trail since starting of when I *should* get my plan, but that's out the window. Verbal promises from 2 executives I'll get paid my "full quarterly variable." New boss "working on it" but can't promise a date or that.


And now I believe they've misclassified me as exempt so either my OTE on paper needs to go up, or they re-classify me and owe overtime.


What would you honestly do if you were in my shoes? (Beyond find a better company, yes I know).

CEO is one of the folks who "promised" this but wouldn't put it in writing. They seem to want to make good now I just need to get it in fucking writing.

Unfortunately, you’ve kind of screwed yourself by not getting anything in writing that’s signed.

No contract - no need to pay!

If they’re smart, they’ll pay you ($700k sounds pretty impressive in any industry). But if they’re more about the money and the culture is shit, they’ll find a way out of paying you

I'm not getting paid on them currently (it would pay out Jan). I am keeping track. I started closing deals in Oct, Nov, Dec (inherited pipe). I've been shown but not given copies of 2 different comp plans they're "finalizing." Nothing has been signed. I'm requesting via email the 2023 plan. It's all so shady.

Have you kept a record of your transactions and what SHOULD be paid to you, based on what you were told?
And was the only person to promise these things the departed Head of Sales, or have there been others involved?
Savages - isn't there someone on LI who actually is good at this kind of thing, by which I mean retrieval of comp? Brought up before, name escapes me.
For $700K, you should be getting something, and something very soon. This is ridiculous.
I would work on the exempt/non-exempt thing separately. What is the point of a higher OTE if they're not paying you part of it? If/when they reclassify you, you can work on getting the OT. That is something that actually can be managed by the feds; I have gotten back pay before when I was misclassified (but in good faith) by an employer, and there was an audit.

Head of Sales and CEO. Yes there is. I may pay to consult at this stage honestly. I was trying to do what I can based on research and to resolve internally, but it's getting sticky and I want paper trail and to take care of myself.

damn, sounds like they are doing you dirty.. There are some folks on LI who I have seen advocate for people who are getting the barnyard smash from their employers. Cant remember their names off the top of my head, but I'd try to figure out who they are and get in touch for advice.

ALSO, keep a paper trail of everything. C/W records, expected payout, promises made.. Keep it on your personal computer, you never know when you work laptop will go dark on you.
