Negotiating a separation package in the event offer is rescinded?

Hey Savages. I've seen a lot of posts around people having rescinded offers due to "economic downturn" from the company; most notably, Coinbase. 

To make matters worse, they've already put in their notice, or have left their current jobs. 

Here's the $64k question:

Do you believe candidates should negotiate a pre-employment separation in the event of rescinded offers due-to-downturn? Also, do you feel companies who rescind offers should be open to that discussion?

That’s always a risk, but a double sided blade. While it is defensive and protects you, I can see a company saying “don’t you believe in the company? Why would you take an offer if you think we will rescind it?” Be prepared to preemptively answer that, and you are golden. You are a salesperson after all.

Great point! If a company feels strong within themselves, they should be ok with agreeing to “hypothetical” that wouldn’t happen due to confidence in their company.

Not sure how that would play if brought up during the offer discussion. As @FinanceEngineersaid, it could potentially backfire.

You'd really need to think it all through.

Companies rescinding offers like this should absolutely offer some compensation though. I've read about people who left other org's and were going to lose their work visas due to this BS.

You need to call out the rebuttals in advance. That way, they know where you are coming from since you are putting in notice. Or just don’t leave the old job until you start the new one

I have never heard of this. I understand the motivation from an employee's POV, but what's in it for the hiring company? How many times have they had accepted offers out and the employees decline to show and don't honor the contract? There's a flip side here. I don't see how it would work, but I'm interested in this discussion.

no i dont disagree with that. what I mean from a practical stand point is that would require compliance, legal, CFO approval of saying they will not do rescind offers and I bet they would not be too keen to promise that. Thats all im saying.

right it takes some workaround but im sure its a tactic that would help put there offers leagues ahead of the rest - if ur a recrutier like damn - i just saw a post here that someone wants to job hop but doesn't want a offer to rescind

yeah i think if you dont want to take a job because you are afraid of the offer being rescinded then......i cant help you haha. do what you can to protect yourself, and dont burn bridges.

exactly, you shouldnt be jumping to a place u think would rescind the offer or would do something like that.

I always negotiate a severance clause to get me more than just 2 weeks (at best) if they let me go. But I haven't heard of them rescinding offers, beyond the few which have made headlines. I imagine that rescinding an offer after you accepted and quit your current job could land them in legal trouble, but I'm not a lawyer so I don't know.

You can always bring it up in a conversation with the recruiter/HR rep. BUT....that's a double edged sword and to some people could be insulting (especially upper mngt types who the recruiter/HR person would have to take your request to for approval).

AND... while the rescinded offers make headlines, they are quite rare. I wouldn't worry too much about it personally and I'd put more effort into a severance clause/payout.

so if I was a company i would 100% NEVER do that.

If that was the case they would just NOT rescind the offer potentially.

idk how this would even work? You would have to sign an agreement once an offer is made that they cant take it away from you before you are hired? what about after you are hired?

I feel like this would hurt you more then help you.
