Will your organization accept an uncapped limitation of liability clause?

I've never worked for a software company that will accept an uncapped limitation of liability. Every prospect/customer asks for it and their legal team always swears that every other vendor gives this to them. Is this a BS claim? Take my poll below:

Thereโ€™s no insurance company out there that will offer uncapped liability at least not that I know of so if a company does that it is putting them at serious risk and worse case scenario they could be bankruptย

Exactly why it's a crazy ask. Usually just slows things down.ย

I've never had someone ask me for this before so I am not too sure. Interested to understand what it means exactly if you can explain to this newb?

It can mean a lot of things. In the software sales context it usually means if there's a data breach and the software you sold them is involved they're entitled to compensation for the resulting damages. An uncapped LOL would mean your customer has a blank check to cover anything they can define as a damage due to the breach.ย

Yikes!! Appreciate the clarification! Thankfully none of my clients have ever requested this. I don't think my legal team would be down at all
