Commission after resigning from a role?

I know Bravado is not a legal firm, but I'm sure something like this has happened to someone before. If the best advice is to seek an employment lawyer, I'll do that then.


My company pays commission when payment is received from clients, not when invoices are sent out. Let's say I've invoiced a deal that when my company collects the money, will pay $10k. It will most likely happen in late January or early February.


If I leave the organization with the outstanding commission out there, are they obligated to pay me it? I went through my initial agreement with my employer and didn't see anything listed under commission compensation that would answer this.


Also, do companies offer signing bonuses through negotiation? I'm curious what the war room uses tactics wise when negotiating with a new employer.

As pbc said, it should be outlined in your comp plan. If they violate the comp plan, that's when you'd need to hunt up a legal response.

It's all about the paperwork.
You're unlikely to get anything unless it's stated you are entitled to it.
You should absolutely try to negotiate a signing bonus though.

What does your comp plan say? If it’s not listed that you will receive owed commission after departure then you’re not going to get it.

I’ve negotiated a signing bonus for pending acquisitions equity payouts. If they want you bad enough they’ll pay you.

If there’s nothing in your comp plan about this, I’m afraid you’ve got your answer … nothing.

Shitty but it is what it is. Agree with the folks above, could be worthwhile negotiating a signing bonus on the likelihood that you’ll forfeit those commissions by joining this new org

+1 read the comp plan but most places if your ass is not in the seat when commish is paid out, then you do not get it. I've seen people argue it if they've been let go but if you resign then yeah you basically forfeit it.

Usually I've seen companies pay out if payment is received within 30-90 days but depends on the terms. Some will just payout whatever is collected by your last day.
