Hiding from a firing

Have a teammate who was going to be let go on Friday. He must have suspected it or somehow found out because he put 3 weeks of PTO on his calendar is has gone completely non-responsive to any management trying to get in touch with him.


Has anyone seen anything like this before and know how this will play out legally? Anyone have any better quitting/firing stories?

ahaha wow that is a good move on his part.

idk if the company has any real legal action they can take. as long as his PTO was approved or how ever that has to happen at your org.

probably not a bad move for him to start looking for new gigs if he is afraid of being in a tough spot.

definitely wasn't approved but we're still pretty small so don't really have any formal process + unlimited PTO. His Slack's still active bc I guess they can't officially fire him without talking to him

I actually canceled my PTO recently for this week since we get paid out at the end of the year and I suspect my company will be doing layoffs again.

In case I'm on the chopping block, I'd get paid out for my unused PTO instead.

I will say, your coworker is ballsy lol, I can't fault him though.

I work remote, so not too sure. We use zenefits and I just cancelled my approved hours two days prior.

Since you mentioned you're a small company, if it's not properly approved then I've seen in hiring contracts that if an employee isn't responsive for 3,4,5 (however many) days then the employer takes it as resignation.
Does your company have a policy like this?

Also, props to the employee, we are always expected to give 2 weeks, but when being let go there is no warning.

I have not heard anything like this before.

Craziest story I heard of was a low performer was about to get fired and was even caught faking meetings. A manager called his last meeting, and the client said they didn't meet.

The rep started recording personal calls and trying to get dirt on leadership after, super weird.

Since you don't manage him, I'd say "its none of your business". But I get that its a good piece of office gossip.

He's burning his PTO as actual time off rather than a check - I guess that's up to him. Hope he uses the time off to job hunt.

He might get 2 weeks severance when he gets back but I'd guess they fire him the moment he walks in and he gets nothing for pulling a stunt like this.

Others have said it and since it was not approved PTO, that would most likely be considered a no-show. That is generally seen as a voluntary resignation which means no unemployment for him.

Should've taken the firing, got paid out whatever else (seems PTO would get paid out since Massachusetts), then got on unemployment to bridge the gap.

The only saving grace is if he can get a written confirmation this was the plan anyway, which seems slim to none.

I wouldve checked out while working and made them cut me that sweet sweet unused PTO check, unless you are unlimited PTO then sick move by them

I have seen this 1 time before and the person didn't even put in PTO they just didn't show up for a week. So the manager called him on the Friday because they couldn't get a hold of him and fired him over the phone via voicemail

I'd imagine that since the PTO wasn't approved, that he'd have no right to compensation during those days.

Also, can't they just fire him via email instead?
