Leaving my company and they won't pay me full commissions due to quarterly invoicing...

Quick recap on my situation:


I recently decided to leave for a better opportunity, my last Q ended up at 100%.

For the final paycheck, they say that they are only paying me for 60% as 40% is still being invoiced on quarterly invoicing so therefore they cannot pay me the 40% in case of bad debt.


Is that normal ? Any advice ?

Really depends on how your commission structure is set. Sometimes it's paid upon a signed deal, often paid out when the invoice is paid (non-saas), or rarely I've seen paid out after implementation.

Check what you have in writing.

Thanks, this is what they claim to be the reason to avoid paying commission:

"Commission is paid quarterly in the month after the quarter closes.Any late payments from customers or bad debt will be taken into account in commission"
However no clients are late, some of them are just on quarterly invoicing...

I would say depending on size of commission and how much you think they will fight it, you should consider consulting a lawyer who specializes in this.
I know there are some good posts on here regarding withheld commission.

If the company pays you today on Q4 2021 and Q1 2022 billings, and they get stiffed, they will have no recourse to claw back that money from you. Standard rev practices, sadly.

Read your comp plan. At my last org, we lost sales folks all the time (industry trends). They were not paid a dime for deals that were not marked as paid-in-full before they left. This was written explicitly into the comp plan, but didn't stop folks from asking for it.

I had faced the same in the past and haven't received the money when l left, but it was clearly mentioned in my paperwork that I won't be paid for something that's not been invoiced.ย

You need to refer to the employee agreement you signed when you were hired.

What do you think? I caught Covid at a company sponsored team outing, I took a two week paid leave to recover and received no quota relief for the month of August.

FEELINGS- Your commission is annual (ARR) but the customer paid monthly (MRR) and if there is a churn in the next few months, the company will deduct by increasing your quota and taking the equivalent amount $$ from your quota in the next month.
