Haven’t been paid commission

I’m a manager and haven’t been paid my Q4 commission and it’s approaching Q2

is this legal? I have asked for my money multiple times

**Edit

They are supposed to pay me the beginning of the next quarter.

We have no banking issues luckily as of now and we raised 6 months ago

They told me they'd pay me by today march 15 after me asking for 6 weeks. but it did not come in today.

You need to read your comp plan to see what is going on. What have they been saying when you ask?

This isn't a good sign... You need to think about how it's worked in the past, and look at your employment agreement.

Also try and see if there's something larger at play with your company given the economic environment.

What is the response they have given you? Also, how does commission typically get paid out? is there a waiting period or invoicing period that needs to be met?

Is this your first quarter in the company? Have you received any circulation about the delay in the payment? You got to read your paperwork. If the timeline has passed, I would definitely talk to my superior.

My last company delayed Q2 commission payout for 6 weeks. Two weeks after they finally paid they did their first round of layoffs. And then another round 2 months after that. And then a third round back in mid January.

Can you talk to the team you manage and find out if they've gotten paid commissions correctly and timely?

You're likely shit up a creek if your comp plan (that you signed I assume) doesn't have details regarding payout.

What is written in your legally binding compensation plan?

Do you have anything in writing?

If it's in your written out and signed compensation plan and they are not paying you, that's an issue.

If you do not have a written and signed compensation plan, that's another issue. However, if you do have emails stating when you're to be paid, that is written.

Now - if they just aren't paying you, is it because there is some issue with the customer or is it because despite what they're saying, they do not have the $$?

Did you ask em for the reason of the delay, and usually how long would it take to get paid a certain quarter and if any contract term regulates this part.

If not, advise you to wait till the end of March and start escalating!

When in doubt, just ask for your money. "When should i expect my commission?" You earned it, GET THAT BREAD

And bring proof of 1) comp plan 2) your metrics 3) amount you're owed
