Need advice on quitting

I'll try to keep it as short as possible but need some savage advice. I received an offer from a company with an accelerated start date (I start Monday the 10th). I did not give a full 2 weeks notice because I needed to keep my health insurance as long as I could (new insurance doesn't kick in until 9/1) because of the possibility of being cut immediately after giving notice. Gave notice today and they said I cannot give less than 2 weeks notice, but I start Monday and travel all next week. Any advice on how to handle properly?

Just bounce dude. You didn't intend on it being as such. Be forthright and don't burn bridges, but there is nothing stopping you from leaving.

Bro. Give 2 week notice. Just call in sick with covid next week.
99%of companies will fire you the hour after you put in 2 weeks and tell you to get lost and pay you out. They don’t want a disgruntled employee sitting there talking shit to the team. Go to new company and just start working. F your old spot.

Where do you live?

Review your employment agreement. If you're in the US you are most likely "at will" -- meaning you can quit whenever you like.

US based so I can definitely quit. I never give a full 2 weeks as I know they wouldn't give me 2 weeks notice if they were going to lay me off. Just a strange thing to say as they wouldn't accept Friday as my last day

From an employer's standpoint, I can see how your leaving might leave them in a lurch. But so be it; that is the way of the world. If you are respectful and tell them you cannot work past Friday because your new job starts, then that is what it is.
If they make a big deal over it, they are just making noise to make noise.
And I always had a problem with employers firing employees when they give their two weeks. I would rather that then they just not show up one day.

You absolutely CAN give less than 2 weeks notice.

I've never had management not accept a resignation. I never give a full 2 weeks so I can protect my income and benefits the last 2 weeks.

An “accelerated start date” accompanied by a 90-day wait period for insurance is a yellow flag friend…. Sleep with one eye open at the new gig

It's 30 days after the 1st of the month that I start. The start date was to get me into a new role quickly, which I asked for. Hopefully it's a good company. They seem very invested in their employees. I dont trust any company, but there are still decent ones out there. Just harder and harder to find.

It is illegal for companies to force employment and employment is at will, guess what if they had to lay you off they wouldn't be giving you 2 weeks notice for it... fuck em

They said they will take legal action if I don't give 2 full weeks due to the employment contract.

Do you see it specifically listed in the contract

They said I need a reasonable effort to give 2 weeks notice, and then it states it's at will employment.

Yeah and in most at will states these clauses in Contracts hold zero weight. Who defines a "reasonable effort"? If it's not spelled out it's unlikely to go in their favor but they do it to scare people into complying.

No chance they will take legal action unless you are very high up and have a no-compete clause

Did they say why you could not give less than two weeks notice? I know it is typically customary to give 2 weeks, but interested as to the reasoning

Management is expected to give a full 2 weeks. I rarely do that because I try to protect myself from losing 2 weeks of pay/benefits as companies immediately fire many times.

Gotcha, so no legitimate reason, seems like you can cut loose whenever (at risk of severing the relationship with current company)

I'm good with severing it. Ranks toward the bottom of job experiences and I've had some shitty ones

I think in that case, you pull the trigger on Friday. They know that you are on the way out, it will keep some semblance of a relationship but gets you to where you need to be.

Do you foresee any legal issues with working both jobs (current job would take 1 hour a week max) until my "2 week notice period" is up?

Not unless there is something written into contract with new company stating that you can’t have another job

It could be a fire able offense for the new company, not worth it.

They came back and said 2 weeks is in my employment contract and if I take the job before then they will take legal action

That’s f***ing nuts. What came of this? Also… if they did actually write this into the contract, what a ludicrous policy! “We require that all employees sit around checked out or being disgruntled about not being able to leave on their own terms with their thumbs up their you know whats.” Bizarre in the extreme.

So is main concern the benefits piece? I am not sure how you can get benefits outside of cobra for the month of august if the new job doesn’t start until 9/1.

Unless you have a partner you can hope on for a month.

Outside of that, you can just leave the old job whenever. Tried to be nice but now they don’t get a notice

COBRA can be retroactive. As in, if you have a 1 mo gap and you do not need to visit a doctor during that month, you could go without coverage. If something happens (eg an emergency) you can sign up and back date. That said, it’s been a long while since I did this, so I’d check. Also, of course your medical concerns are private, so this may not work for you at all, and I’ll take a seat.

Because I stayed the pay period I have benefits until 8/1. My wife can get benefits but they're extremely expensive. Had a few appointments this month we were trying to have covered by my health insurance rather than hers.

Don’t sweat the insurance piece too much. Even if you quit COBRA is available. It costs significantly more, but for the short term can cover most things.

Also if your hesitation is due to prescription coverage, just download GoodRX app. Many times your drugs on their could be cheaper than insurance coverage.

Can't you keep insurance through Cobra?

Employment is at will. That works both ways. It’s courtesy to give 2 weeks notice and if they walk you out that day your insurance still Carrie’s to the end of the month

I would give them the 2 week notice, and let know your new hire that you are doing soo. That will show that you are responsible and reliable employee.
