Got F***ed on Severance Payout

So I was laid off recently from my BDR role as part of restructuring (80% of our canadian operation was gone) at a pretty reputable company back in Feb.


Worst part about it all was that I was supposed to be interviewing for an AE role in Jan internally, as I was eligible and one of the top performers, or at the very least be promoted to a SR. BDR role. BUT they kept pushing it out and now I know why. This part isn’t all that relevant but I guess it adds to the frustration.


Anyways, now that there is context - our deadline to sign the separation agreement was Feb 28, I didn’t sign it till March 2nd and I’m still regretting waiting till the last minute.


I was unable access the document due to some issues on the backend on the 28th so it really wasn’t even my fault.


All my colleagues (even people who were there for much shorter period than me) got paid out almost double the amount that was written in the contract. I didn’t get anything! Emailed HR and turns out because I signed late, my payment would be delayed.


Everyone was pleasantly surprised and I was looking forward to getting paid the same amount as well. The day finally comes around and it was half the amount the rest of my colleagues got!


I emailed HR explaining the issue and they just reiterated that they paid me exactly what was agreed upon in the contract, which was true.


But then I asked why was it that my colleagues, with the same title, were paid twice as much even though we all signed the same contract. They took an entire week to get back to me, and really just threatened me with legal action saying our contract states that we can’t discuss terms and payments with current or ex-employees. They can’t give me any information at all and that they paid me in accordance to the contract.


Pretty much got told to fuck off.


Even if it was an error where everybody got paid out like that, it still feels unfair. I took a vacation keeping in mind the amount that I thought I would get paid and it all just sucks.


I have yet to speak to an employment lawyer regarding this but it feels like there isn’t much I will be able to do.


If anyone has experienced something like this, or can give any advice, it would be greatly appreciated!

You got paid what it said you will be paid. You are trying to breach your contract on a settlement (which is what severance is), so if you bring it up in court, you might even have to pay that amount back. Just take it as a lesson learned.

I'm sorry it happened to you. Unfortunately, you learned a bit of a lesson here - don't delay signature (in case bad things happen) and don't spend money you don't yet have in the bank (because it's not a sure thing until that happens).

We all learn things the hard way sometimes. Make sure you take this as a lesson learned, and good luck to you moving forward.

Yeah, unfortunately not much you can do. But if you want to light them on fire, now is the time. I don't think they can legally prevent you from discussing pay. Or rather, you can't in the U.S. Could be different?

I'm going to say something that is going to come off as a dick, why would you wait til the last minute to sign the agreement? It sucks that all the others were paid more than you but the company paid you out in what I assume was at will employment so it wasn't like they owed you anything. and here is the more important point 98.5% of companies don't give a shit about you, treat them as they will treat you.
