Pursue or not Pursue?

So, without revealing too much about myself.

I've had multiple professionals advise me to take legal action so your input would be appreciated.

Here goes. After multiple years with the same company, zero history of ever being on a Performance Plan, and two months after suffering a heart attack...I was placed on a PIP and four months later- FIRED!!

As a seller, we had a designated sales territory under our "rules of engagement," however, my SM at the time knew this rule wasn't being adhered to and turned a blind eye to these individuals.

Interestingly enough, I was ranked about middle of the team but I was the highest paid Sales Executive on the team and had the most years of service.

I'm a very hard worker and have always been top 20% in sales results for most of my career with this same company. However, this just didn't feel right.

I wouldn't even know what type of law firm to speak with, if any, but I would value your feedback. Much appreciated!

Man, this is tough to read. Sorry this happened to you.

There's some tenured vets in here that will likely have applicable steps to take.

At the very least, it's probably worth contacting a few law firms that specialize in wrongful termination. Get organized asap. Everything you have in writing. Performance reviews, any recognitions, references, etc.

This is at least where I'd start.

Now fully recovered- TY! At the time, mentally really took a toll on me. Looking back on it I should've stayed out on disability.

Thanks for tagging @detectivegibbles. From where I sit, this has a common thread of various sorts of discrimination running through it. Age being the primary concern. Did you know youโ€™re in a protected class at over 40?

The legal particulars will vary from state to state. But I would immediately seek legal advice. This is pure nasty. What state are you in?

I'm not familiar with Georgia state law regarding wrongful termination, but a couple of free consultations with employment attorneys in your area might offer you some insight into wrongful termination. Without knowing specifics in your situation, is it possible there are ADA, and/or age discrimination factors in play? Most likely there are no fees unless your case is won.

It's really been a "kick in the teeth" especially since I've given practically my entire life to this company. Do I feel like I was targeted? YES!! I have an email sent to my DOS at the time where I disclosed that I felt like I was being targeted- he acknowledged that I was. I'm not sure what was meant or the purpose by which this was intended...clearly, I was the one they wanted gone.
Time has passed, end of 2021, but this still haunts me so much so I thought I'd broach it one final time. Thank you!

Thank you @Sunbunny31 Definitely in a better place...formed an LLC installing equipment at local hospitals. But, really want to get back to work in sales if that's at all a possibility. Reading through these post doesn't help.

All very good advice...thank you! After reading through the comments, I believe it's in my best interest to reach out for Consultation to determine whether or not I have a legal basis or not. This is the first time I've requested feedback so very impressed with the knowledge level. Directionally, I'll let you know if this goes anywhere.

That is shitty. I am sorry that this is happening to you.
As others have stated, I would gather all the evidence... work history, bank statements, emails, medical bills and statements etc.then look into wrongful termination and I think just talk to a lawyer.

Tough to read this. I would contact legal firms however, I wouldn't be surprised if they tell you it will be somewhat expensive to pursue legal action. If it was at-will employment and all it's likely tricky to take up action

With the heart attack and age considerations, definitely worth taking a look. Seems like it would be a long road, but there seems to be some things at play worth diving deeper with attorney's in that space

I don't fully understand what is happening here but it sounds like it sucks. Employment attorneys are great. Send any internal communnications you have regarding this to your personal email so you have a record of it because when you don't work there you won't have it anymore.

Sorry for the sit, and hopefully your health is way better by now, just really can't believe how they didn't appreciate your medical condition as if they were waiting for a chance to see you sick to put you on that PIP instead of getting you the required support once you came back!
You said it, as long as your contract doesn't regulate that part of being put on a PIP as a No-Go due to health issue , unfortunately your case might not have the judicial endorsement, so I won't recommend going legal tbh or at least before taking that step - as advised by your professionals-in order to avoid unneeded expenses, you'd better consult a lawyer to see what he thinks before taking things further instead of filing the lawsuit directly by yourself and perhaps regret it later.
For certain you've been the best there and your numbers were speaking for you, so definitely they were the ones that lost not you ,and best of luck at your next job search with a better opportunity to come!

I asked not to take the legal path as a step I recommend and that's my opinion as I believe the contract needs to regulate such scenario.
But since some professionals he knows and trusts already have advised him to proceed with the legal action - and he might lean to their opinion- I advised him then to avoid filing a lawsuit by himself before at least a quick consultation by a lawyer to see if taking this path will be that fruitful and what chances he has in order to win!
