Sudden Commission plan meeting - what should I do?

Hey Savages,

Started at a new company 2 months back. As part of my offer letter, they stated I'd get a fixed percentage of the sales teams $$$$ for the financial year etc.

Suddenly had a last-minute comp plan meeting put into my diary, with the only note being that I'll be presented with my personal commission plan.

The sales ops manager was just being onboarded when they put together my offer, so they may use it as a justification.

Not trying to rock the boat, but how do I make sure I get my number if they try and renege.

Right now I'm running a kidnap the first born, get the second born for half off. I'll even throw in one monthly phone call for 20 seconds to the first born if you can commit today.

Hi @InQ5WeTrust. Get a copy of your original comp plan and make sure there’s no language that says something like, “this can be adjusted based on the needs of the company.” A lot of comp. plans have that provision hidden somewhere deep in your employment contract, employee handbook and those supersede your offer letter. Second - go into it with open ears. Don’t accept anything on the spot. Stand your ground if you can afford to (weigh the option of getting let go and getting nothing). But maybe they’re just presenting you you’re number and it’s what you were expecting. Third - play the long game, get a copy of every document in that meeting and if they pull some bull shittery, find an employment attorney outside of work and explore it quietly and while still employed. IE - I got a raise this year and my boss even said "if things get tight we will have to get creative." Which meant, "leadership takes the first haircut." but at least he told me upfront and set the expectation. Good luck and I hope everything goes smooth!

Re: Offer letter vs Employment Contract

Really? My lawyer said the opposite (offer letter supersedes) when I left my last firm. Granted, it was regarding a two month notice provision and not comp plan but one would assume that it’d make no difference.

The company can change your comp whenever they want. Unless you’re on a contract which is different than an offer letter for employment.

Not debating that, it was more a question of what document supersedes what

The offer letter should begin with a statement that includes information such as the position title, start date, orientation date, full- or part-time status and applicable shift. Employers should avoid using phrases that imply an indefinite future of employment, such as "job security," "we're a family company" or "in the future." Organizations may also want to include language that the company has the discretion to alter or rescind information contained in the offer letter during the course of a worker's employment.

I obviously can’t see your old offer letter but the first part of this template says, “how to write an offer letter without contractual implications.”

I guess it depends on how your employer crafts it.

Curious to see. All of my comp plans have said subject to change. When you were on boarded did they say it may change? Or it was a temporary plan? Are you on a one-off?

good luck and keep us posted.

I would listen with an open mind to what they're presenting to you.  I would DEFINITELY ask for a side-by-side comparison between the two which any ethical company would do.  If it's less $ commissions then I would ask for more equity, higher base, etc.  You can even ask for a promotion or for them to create a new job/pay band that would fulfill your request.  Lastly, more money doesn't always equal peace of mind.  Took me a long time to figure this out.  Keep us posted with an update thread.

Does your offer letter say something like "Company X reserves the right to change your competition plan at any time" (as 99.9% of them do?

Say no, and threaten to sue. This isn’t a one-sided conversation. . They signed a contract with you too when you started, and obligations have to be kept, or they’re liable.
